Attempts to seek that light at the end of the tunnel to the SC

The Times of India reports that the SC will tomorrow hear a Petition which has been filed seeking to disqualify Mrs. Patil from the Presidential race.

The matter will be taken up for admission tomorrow.

In all probability, the Petitioner would be asking the Court to look into news reports and determine as to why charges were not framed ever at any stage against her.

The Court will in all certainty make the Maharashtra Government, especially the Police one of the Respondents and seek explanations on the matter.i.e. if the Court shows any inclination of admitting the Petition tomorrow.

Hopefully the Petitioner would have collected data akin to that compiled by Yossarin.

It will take a more than ordinary performance by the Petitioner lawyer Mr. Sharma if we are to have the Court looking beyond the letter of S.8 of the RP Act (which requires charges to have been framed or cognizance taken ) and thus get anywhere close to upholding the Petitioner’s prayer.

Mrs. Patil’s arguments and that of the EC would be banking on strict adherence to the letter of the law i.e. the language of section 8 and the 6 months embargo for disqualification.

Let us hope for the best !
